Domestic violence are criminal matters where one member of a household inflicts harm against another. Most criminal cases involved a wife who makes a complaint against a husband, though many times genders are reversed or other parties may be involved.
The crime with which the defendant will be charged depends on the severity of the victim's injuries, if any; whether minors were presnt and if a restraining or protective order was violated. Some of the Domestic Violence charges for which a defendant may be arrested are:
During the court proceedings in domestic violence cases, it is common for a full order of protection to be granted so the defendant is unable to return home. After the case is over, presuming the victim approves, the order of protection may be lifted or it may be a limited order of protection that allows the parties to interact with each other, but forbids the defendant from committing any future crimes. If a future crime is committed, the defendant will be charged with contempt of court in addition to the crime itself.
